Hungary and Slovakia to Initiate Annulment of REPowerEU Regulation

Hungary and Slovakia will initiate the annulment of the REPowerEU regulation banning Russian energy imports at the European Court of Justice and will request its suspension for the duration of the proceedings, Péter Szijjártó, Minister of Foreign Affairs and Trade, wrote on Facebook on Sunday.

In his latest post, the minister reported that Brussels wants to put the regulation banning Russian crude oil and natural gas from Europe to a vote next week. As he said, the ban would make it impossible for Hungary and Slovakia to secure their energy supply and lead to sharp price increases.

“What is more, this is a huge legal fraud, as it is in fact a sanction that can only be adopted by a unanimous vote, that is completely contrary to the European Union’s founding treaty. The treaty states that energy policy is a national competence. It is also totally contrary to Brussels’ own impact assessment,” he emphasized.

Therefore, together with the Slovak government, we will immediately file a motion for annulment with the European Court of Justice after the decision and request that the regulation be suspended for the duration of the court proceedings,”

he announced.

Fact

In May 2025, the European Commission presented the REPowerEU roadmap following the REPowerEU plan. One of its main outcomes is a new regulation aimed at completely eliminating Russian gas imports into the EU.

The legislation would introduce a ban on imports of both liquefied natural gas (LNG) and pipeline gas from Russia. The ban would be implemented in several stages, with the complete ban of imports of Russian pipeline and liquified natural gas by the end of 2027.
